Getting Married in Thailand as a Foreigner: Documents, Legalization and the Marriage Visa

The Overall Process
A foreigner marrying a Thai national (or two foreigners marrying each other) registers the marriage at a Thai district office (Khet office in Bangkok, Amphur office in the provinces). The hard part is not the registration itself but the paperwork before it: documents issued abroad must be notarized, legalized and translated into certified Thai before Thai officials accept them.
Step 1: The Affirmation of Freedom to Marry
The standard route for most nationalities:
- Obtain an affirmation of freedom to marry (single status declaration) at your embassy in Bangkok — most embassies require a personal appearance and oath
- Have the document translated into Thai by a qualified translator
- Submit it to the Legalization Division of the Thai Ministry of Foreign Affairs at Chaeng Watthana — regular service takes about 3 working days, express same or next day
Some nationalities can alternatively prepare the document in their home country (local notarization, foreign ministry authentication, then Thai embassy legalization) — the legal effect is the same, but doing it in Bangkok is usually faster if you are already in Thailand. The affirmation has a limited shelf life (best used within 3-6 months of issue), so don't obtain it too early.
Step 2: Registration at the District Office
- Both parties attend with passports (the Thai partner brings ID card and house registration), plus the legalized affirmation and Thai translation
- Two witnesses must sign; some offices can arrange them on the spot
- A party who doesn't speak Thai needs an interpreter — some offices insist on a certified one
- You receive the marriage certificate (Kor Ror 3) and marriage registration record (Kor Ror 2) on the spot
Registration itself is free or a token fee, and normally done in a morning. Popular Bangkok district offices may require a phone appointment.
Step 3: Making the Marriage Recognized at Home
To use the Thai marriage certificate in your home country (residence matters, spouse visas, property affairs), reverse legalization is required:
- Translate the marriage certificate into your language or English
- Legalize at the Thai Ministry of Foreign Affairs
- Legalize at your country's embassy in Thailand (or via apostille where applicable)
Most countries do not re-register the marriage — the legalized Thai certificate carries legal effect.
The Marriage Visa That Follows
After marrying a Thai national, the foreign spouse can apply for a marriage-based Non-O visa for long-term residence. The main financial thresholds (confirm current Immigration rules):
- 400,000 THB in a Thai bank account, held for 2 months before applying, or
- Proof of monthly income of at least 40,000 THB
The marriage visa renews annually, and Immigration may conduct home visits to verify the marriage is genuine. A big practical advantage: marriage visa holders can obtain a work permit without the employer meeting the 4-Thai-employees ratio, and the registered capital requirement is halved.
FAQ
Can two foreigners of the same nationality marry in Thailand?
Yes. Both prepare legalized affirmations as above and register at a district office, then complete reverse legalization for use at home. Some embassies can also register marriages between their own citizens directly — check your embassy's rules.
Can we register again in our home country afterwards?
Generally no — most countries treat a marriage validly concluded abroad as final and do not permit re-registration. The legalized Thai certificate is the operative document.
Do we need a prenuptial agreement?
Thai law recognizes prenups, but only if filed with the registrar at the moment of marriage registration — signing one afterwards is void. If real estate or company shares are involved, consult a lawyer before the registration day.
