Contract Clauses to Read Line by Line
The standard lease is one year, with two months' deposit plus the first month's rent. Before signing, verify:
- Early termination: how long you must stay before the deposit is returnable, and how penalties are calculated — most disputes trace back to this clause
- Deposit return deadline: state how many days after move-out (30 is common) and what can be deducted
- Repair responsibility: major systems (aircon, water heater, plumbing) on the landlord, small consumables on the tenant — put it in writing
- Furniture inventory: photograph every item on move-in day and have the landlord sign the list
- Sublet and guest limits: many condos ban daily sublets; breaching forfeits the deposit
If the contract is Thai-only, request an English version. Verify who you're signing with: before signing with a sublessor, demand their lease and sublet authorization from the actual owner — otherwise your deposit is at serious risk.
The Electricity Rate Trap
The government rate is roughly 4-5 THB per unit, but many older apartment buildings bill tenants at 7-8 THB per unit, adding thousands of baht a year. Ask the exact rate per unit when viewing. Condos rented directly from owners usually run on the government meter rate. Water follows the same pattern — the government rate is about 16-25 THB per unit.
TM30: The Hidden Item That Affects Your Visa
Under Thai immigration law, the landlord must file a TM30 residence notification within 24 hours of a foreigner moving in. The duty is the landlord's, but the consequences are yours: without a TM30 record, your visa extension, 90-day report, and residence certificate applications get blocked. Confirm at signing that the landlord will file the TM30, keep a copy of the receipt, and remind them to update it after each re-entry into Thailand.
Getting Your Deposit Back: A Practical Sequence
- Give written notice within the contractual window (chat or email, keep the trail)
- Restore the unit against the move-in inventory; normal wear and tear (slight wall yellowing, ordinary furniture wear) legally shouldn't be deducted
- Do a walk-through with the landlord present, agreeing deductions on the spot with signatures
- Ask the cleaning fee standard in advance — typically 1,000-3,000 THB
If the landlord withholds the deposit unreasonably, send a formal demand letter first; failing that, complain to the Consumer Protection Board (hotline 1166) or file a small claim. For larger amounts, a lawyer's letter often resolves it in one step.

Can I sign a one-year lease on a tourist visa?
Yes — leases are independent of visa type. But mind your own legal stay: a lease offers no protection if you overstay.
What if the landlord wants the deposit in cash with no receipt?
Insist on a bank transfer with the purpose noted, or a signed receipt. Without payment evidence, recovering the deposit later is nearly impossible.
If I leave before the lease ends, is the deposit always lost?
